Property developer PT Buana Permata Hijau has warned the Jakarta administration to stop the development of the BMW Stadium in Tanjung Priok, North Jakarta claiming that any construction activities by the city were illegal following a ruling in a land dispute.
“If the Jakarta administration continues the development, then they have violated the law. The construction is also illegal,” company attorney Damianus Renjaan said on Friday as reported by kompas.com.
He asserted that the North Jakarta State Administrative Court had recently ruled in favor of the company regarding the 6.9-hectare area. The verdict has annulled two separate land-use right certificates for the Jakarta administration issued by the National Land Agency in 2017 for the location of the stadium.
“The city does not have any right to the land. We want it to abide the court’s ruling,” he added.
Jakarta Governor Anies Baswedan had previously said the verdict would not impede the project and that the city would continue with the development.
He had kicked off the construction of the BMW Stadium in March. The planned modern stadium of international standard would serve as the headquarters of Jakarta soccer club Persija, besides serving various other purposes.
The city had filed an appeal with the North Jakarta Administrative Court to challenge the verdict.
Iwan Takwin, director of city-owned developer PT Jakarta Propertindo (Jakpro) which oversees the construction of the stadium, said the construction was still ongoing. The legal battle had not disrupted the progress, he said.
“The governor was pretty clear that we would continue the construction,” he said.
Jakpro is currently conducting soil testing at the location as part of preparations for the construction, Iwan said. The test, conducted in the non-disputed area, is expected to be completed soon before the company begins with the physical construction.
He added that Jakpro had also measured the depth of the foundations and leveled the soil as an anti-flood measure. (das)
